Chemical Computing Group ULC (“CCG”) respects your privacy and is committed to protecting your personal data. This notice is aimed at informing you of how and why your personal data will be collected, used, disclosed and otherwise processed in the context of your use of our websites (e.g., www.chemcomp.com, video.chemcomp.com) or possible use of CCG products and services.

CCG provides links to web sites of third parties on our websites. Note that these third-party sites are beyond CCG’s control, are not within the scope of this notice and CCG is not responsible for the privacy and protection of any information you may provide to such sites.

Personal Data Collected

When you visit our websites, CCG may collect personal data about your visit, including pages on the CCG website that you visited, your IP address and computer settings. CCG does not retain personally identifiable information about you as result of using our websites unless you voluntarily submit such information to CCG.

When you request information about CCG's products, request an evaluation of CCG’s products, or register for CCG workshops, UGMs or other events, CCG will ask you to provide the following information: your name, e-mail address, employer or institution’s name, physical address and telephone number.

CCG typically engages in business-to-business transactions; consequently, CCG recommends that personal addresses and telephone numbers not be provided to CCG. CCG does not knowingly collect any personal data pertaining to persons under the age of 16.

If you purchase CCG's products, CCG will ask you to provide billing and shipping information, and possibly, information to identify computers such as volume serial number, or similar, for the purpose of generating software keys that enable software and prevent unauthorized use. Prior to accessing any of CCG’s products, you will be required to provide (possibly written) acceptance of CCG’s license agreements, which CCG will retain for its records.

If you contact us directly (e.g., to apply for a position, provide feedback or use customer support), we may receive and store additional information about you such as your name, e-mail address, phone number, the contents of the message and/or attachments you may send us (e.g., a curriculum vitae or technical data), and any other information you may choose to provide.

CCG recommends that confidential proprietary or sensitive information not be provided to CCG without a prior written non-disclosure agreement between CCG and owner of the such information.

Purposes of Collection; Use of Information and Legal Basis for Processing

Primarily, CCG collects, uses, discloses and otherwise processes information to provide you with the services you request. Occasionally, CCG may use information collected to provide you with additional information about CCG’s products and services. More specifically, CCG uses the information collected to

  1. provide and maintain CCG products and services
  2. customer service
  3. processing and replying to requests from customers and their end-users
  4. find and prevent unlawful activity and to protect intellectual property rights
  5. understand how CCG products and services are used
  6. develop new, or improve existing features, functionality and content
  7. comply with Export and Trade Control laws
  8. comply with “Know Your Customer” processes
  9. collect and manage your consents and communications regarding your data
  10. maintain records of financial, service and licensing transactions

Where Canadian privacy laws apply, we must rely on your consent (subject to certain exceptions) to collect, use and disclose your personal data. In contrast, EU laws (GDPR) provide for several legal basis for processing personal data, such as, where applicable, CCG’s legitimate interest (3-5 above), performance of services or the execution of a contract (1-3 above), compliance with laws, regulations and government or judicial processes (7-10 above).

CCG will retain personal data we collect from you where it is necessary to accomplish the applicable purposes listed above and where required by law, whichever is longer.

Data Sharing

CCG may share personal data collected where it is necessary for our service providers to perform their service on our behalf, to comply with applicable law or otherwise where permitted under applicable law. More specifically, CCG may disclose personal data with

  • other companies or affiliates that work on CCG’s behalf, including IT service providers and professional advisors;
  • a potential acquirer, successor, or assignee as part of a proposed business transaction or transfer;
  • a third party to satisfy any applicable law, regulation, legal process, or governmental request.

CCG does not share (except as described in this Privacy Notice), sell, rent, or trade personally identifiable information with third parties.

CCG uses third party service providers to store and/or process data for CCG’s business purposes. CCG reviews its third-party data processors to ensure data security and compliance with CCG’s Privacy Policy. Note that personal data may be exported to countries other than where originally collected. When it is located in foreign jurisdictions, it may be subject to different rules that are less protective than those applicable at their initial location, and may be accessed by governmental authorities depending of the legal framework in place in such country.

Data Security

CCG has appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed. CCG limits access to your personal data to those employees, agents, contractors and other third parties who have a business need-to-know and have a duty of confidentiality.

CCG follows generally accepted industry standards to protect your data, both during transmission and once received by CCG. However, no method of transmission over the Internet or method of electronic storage is 100% secure.

Electronic Communications

In all Commercial Electronic Messages (CEM), such as e-mail, whether sent individually, in bulk communications or automated electronic communications (including CCG’s internal CRM, financial and customer support systems) CCG identifies itself as the originator of the CEM with “Chemical Computing Group”, CCG’s physical address, telephone number and website www.chemcomp.com.

With the exception of fulfilling contracts or communications related to providing products or services you request, CCG will not send CEMs to you without your (implied or express) consent. CCG complies with Canada's Anti-Spam Legislation and Regulations.

CCG will store your e-mail address in order to record, manage and enforce your consent related to CEMs from CCG. CCG provides a free mechanism (Communication Preferences) to let you manage your consent for CCG’s use of your e-mail address for CEMs.

Direct Marketing

CCG does not use third-party cookies (small files placed onto your device) or other internet tracking technologies. When you visit our websites, CCG may use anonymous cookies to protect the site and improve your experience.

CCG does not make marketing decisions based solely on automated processing of your personal data with the exception of the enforcement of your electronic communication (CEM) consents and your city or town to promote CCG’s occasional regional events.

Data Protection Rights

In case you allow CCG to collect and process certain personal data from you, you may have the following rights, which depend on your country of residence. For instance, the rights applicable in Canada and in the European Union are as follows:

  • Withdraw your consent to our processing of your personal data (where the processing is based on your consent and not other legal basis)

  • Erase your personal data (where retention is not required by applicable law or regulation)
  • Object to the processing of your personal data (e.g., use of e-mail addresses for CEMs)
  • Obtain your personal data in a machine readable format
